A conflict has emerged within Nigeria's opposition parties as Hon. Philip Agbese, a Labour Party lawmaker, publicly criticized Senator Ireti Kingibe of the African Democratic Congress (ADC) over her claims regarding the Nigeria Tax Act 2025. Agbese, who represents the Ado/Okpokwu/Ogbadibo Federal Constituency and serves as the Labour Party leader in Benue state, accused Kingibe of spreading misinformation about the new tax legislation, which took effect on January 1, 2026.

The controversy centers on allegations made by Kingibe concerning the existence of a fuel tax and a blanket 25% levy on all earnings as stipulated in the new tax law. Agbese vehemently denied these assertions, labeling them as unfounded and politically motivated, particularly in light of the upcoming 2027 general elections.

In a press briefing held on October 22, Agbese challenged Kingibe to provide the specific legal text that supports her claims or to retract her statements publicly. He emphasized that the new tax law does not impose a fuel tax and clarified that the 25% income tax rate applies only to annual incomes exceeding ₦50 million, while the first ₦800,000 of earnings is tax-exempt.

Agbese expressed his frustration with Kingibe's remarks, stating, "Senator Ireti Kingibe is playing dangerous scare-mongering politics with the livelihood of ordinary Nigerians. She knows there is no fuel tax in the tax reform laws, yet she continues to package falsehoods as fact just to frighten the people and position herself as some kind of saviour."

He further criticized Kingibe's claims that the implementation of the tax laws was being postponed until after the elections, arguing that this contradicts the established timeline of the legislation's enactment. Agbese pointed out that as a sitting senator, Kingibe has access to the full text of the law and should be aware of its contents.

How does a senator who participated in the National Assembly process turn around and tell Nigerians that a fuel tax is coming when none exists?" Agbese questioned. "She is taking Nigerians for a ride, and I will not stay silent while she does it.

In support of Agbese's position, a fact-check has confirmed that Kingibe's assertion regarding a universal 25% income tax is inaccurate. The Nigeria Tax Act 2025 introduces progressive personal income tax rates, ensuring that only those with substantial incomes are subject to higher tax rates. Tax expert Okey Udo noted that Kingibe's claims may stem from a misunderstanding of the law or a deliberate attempt to mislead the public.

Agbese concluded his remarks by insisting that Kingibe retract her statements and apologize for misleading the public, stating that her actions reflect a troubling disregard for the truth amid the current economic challenges faced by many Nigerians.
