In a significant ruling, the High Court of Anambra State has sentenced Silas Uwa to life imprisonment for the manslaughter of his uncle, stemming from a bitter family land dispute. The verdict was delivered by Justice Okechukwu Nwabunike during proceedings at the Awka Judicial Division on Monday.

The case, identified as Suit No. A/63C/2018, revealed that Uwa and the deceased were embroiled in a conflict regarding the ownership of a parcel of land in Ebenebe, located in the Awka North Local Government Area. The court heard that the deceased had been adjudged the rightful owner of the land by their kindred, a decision that Uwa and his siblings vehemently opposed.

On the day of the tragic incident, Uwa confronted his uncle while he was working on the farm. The confrontation escalated into a violent altercation, during which Uwa fatally attacked his uncle with a machete. The prosecution, led by Chief State Counsel Ifeanyi Oguejiofor, presented a strong case against Uwa, calling four witnesses, including the Investigating Police Officer, to testify.

Despite the defense's argument of self-defense and claims that the prosecution had not proven murder beyond a reasonable doubt due to the lack of eyewitnesses, Justice Nwabunike ruled that sufficient circumstantial evidence supported the prosecution's case. The judge emphasized that murder could be established through various forms of evidence, including circumstantial proof.

In his judgment, Justice Nwabunike stated, "The court further held that notwithstanding the absence of direct eyewitness evidence, the prosecution proved through credible circumstantial evidence that the defendant killed the deceased. The plea of self-defense did not avail the defendant in the circumstances."

As a result, Uwa was convicted of the lesser charge of manslaughter and sentenced to life imprisonment. The case has drawn attention from legal experts, with Nonso Emeka, Secretary of the Law Officers Association of Nigeria, Anambra State Chapter, highlighting the importance of resolving land disputes through legal channels rather than resorting to violence. Emeka reiterated the directive from the Anambra Attorney-General, Tobechukwu Nweke, SAN, encouraging disputants to pursue civil remedies for land claims instead of engaging in self-help actions that could lead to criminal consequences.
