The UK government has announced a new pathway for holders of the Innovator Founder visa to qualify for indefinite leave to remain (ILR) in the country after just three years of residency. This significant reduction in the time required for permanent residency is a notable change compared to other visa categories, which typically demand longer periods of residence.

According to guidance released by the UK Home Office, applicants for ILR must meet specific criteria, including spending no more than 180 days outside the UK in any 12-month period during their three years on the Innovator Founder visa. This visa category, which replaced the older Innovator visa, allows entrepreneurs to establish and run innovative businesses in the UK.

Successful applicants will enjoy the right to live, work, and study in the UK without restrictions, access certain benefits, and eventually apply for British citizenship. The application process for ILR includes a fee of £3,226 per person, and it can take up to six months for applications to be processed, depending on the complexity of individual cases.

A key stipulation for applicants is that once they submit their ILR application, they are prohibited from traveling outside the UK, Ireland, the Channel Islands, or the Isle of Man until a decision is made. Any travel during this period will lead to the automatic withdrawal of the application, making it crucial for applicants to plan accordingly.

The Home Office has also advised that applicants should not wait until their current visa expires to apply for ILR. If a visa lapses before the applicant becomes eligible for ILR, they will need to renew it, which can add both time and cost to their immigration process. Applications can be submitted up to 28 days prior to the eligibility date, but submitting too early may result in outright refusal.

This announcement comes as part of the UK government's broader efforts to attract talented individuals from around the world, particularly in the entrepreneurial sector. In addition to the Innovator Founder visa, the UK has various other visa options, including the Graduate visa, which allows foreign graduates to remain in the country for at least 18 months after completing an eligible degree.

With these changes, the UK aims to create a more accessible immigration pathway for innovators and entrepreneurs, enhancing its position as a global hub for business and innovation.
